A Lawsuit Overview

Hyland’s lawsuit is a real estate transaction in the county of Montgomery and has been going on for some time. The dispute is whether the seller of the house, Robert Johnson, was being held liable for past due maintenance of the home. There were repairs made to the property prior to the sale but a lien was placed on the property. Robert Johnson died in a car accident prior to the sale. It was discovered that there was still a lien on the house.

After Robert Johnson’s death the deed to the house was conveyed to his daughter by her husband.

Robert Johnson lived in the house until he died. After his death the house became the responsibility of their son Michael. Michael had no interest or involvement in the house until the current owner, Diana Hylands, purchased it.

On March 8th, 2021 a meeting was held to address the issues regarding the house.

During this meeting the plaintiff’s attorney, Ms. Ann Hyder, brought legal advice to the meeting. As a result of this meeting a settlement was reached. The terms of the settlement are confidential between the parties involved. No one is allowed to speak about this until an agreement has been reached in the matter.

If the parties involved approve of the settlement terms then the agreement will be entered into a court record.

Once the terms have been agreed upon then a lawsuit will begin. The plaintiff is expected to have her case completed within three years. If the lawsuit proceeds then the plaintiff will be entitled to compensation for lost wages, pain and suffering, past and future medical expenses, funeral costs and personal injury damages. In many instances the lawsuit also covers the cost of any medical care that is needed for the victim.

This type of lawsuit can be very complicated. It takes a long time to get a trial going.
